Right of Withdrawal for Digital Content

For contracts on the supply of digital content not delivered on a physical medium, the right of withdrawal expires pursuant to § 356(5) BGB once the trader has begun performance of the contract, after the consumer has expressly agreed that the trader may begin performance before the withdrawal period ends, and has acknowledged that this consent causes the loss of the right of withdrawal once performance begins.
